TrueMove Terms of Service

1. Introduction and Acceptance
Welcome to TrueMove, a social gifting app for respectful outreach and optional physical gifts. These Terms of Service ("Terms") constitute a legally binding agreement between you and Givioo Techcrafters LLC ("we," "us," "TrueMove," or "Company").
By creating an account, purchasing a gift, or using the TrueMove mobile application (the "Service"), you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE TRUEMOVE.
NOTICE ON DISPUTE RESOLUTION: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 12). THIS MEANS DISPUTES WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT.
2. Eligibility
To use TrueMove, you must meet the following requirements:
- Age: You must be at least 18 years old.
- Availability: The Service is offered through the App Store and Google Play. It may not be available in every region. We may restrict or discontinue access where required by law or at our discretion.
- Status: You have not previously been permanently banned from our Service.
- Safety Representation: You agree not to use the Service if you have been convicted of violent crimes, sexual offenses, or crimes involving harassment or stalking. We reserve the right to remove accounts that pose a safety risk to the community.
3. Account Security
You may sign in using Sign in with Apple (on iOS) or Sign in with Google (on Android). You are responsible for maintaining the confidentiality of your login credentials. You are solely responsible for all activities that occur under your account. If you believe your account has been compromised, you must contact us immediately at support@truemove.app.
You may request account deletion from the Account tab in the app. Deletion is subject to our Privacy Policy (including the 30-day restoration window, permanent deletion thereafter, and the ability to create a new account later with the same sign-in provider). Deleting your account does not cancel a permanent ban or other enforcement action.
4. User Conduct and Community Rules
TrueMove is a social gifting platform built around respectful outreach. Optional gifts are voluntary gestures. They do not purchase replies, meetings, or continued attention. TrueMove is not a dating app. You agree NOT to:
- Use the Service for any purpose that is illegal or prohibited by these Terms.
- Harass, bully, stalk, intimidate, or defame any other user.
- Use the Service for commercial solicitation (spamming) or prostitution/human trafficking.
- Impersonate any person or entity or post photos that are not of you.
- Scrape, mine, or use automated systems (bots) to access the Service or collect user data.
- Pressure, manipulate, or coerce another user into sending or accepting a gift.
We reserve the right to terminate your account immediately, without refund, if you violate these rules.
Reporting, blocking, and moderation
- Safety tools: The Service includes in-app report and block features (and you may contact
support@truemove.app) so users can flag concerns and limit contact, consistent with app store requirements for user-generated content. - What we may do: TrueMove may review reports and related content at our sole discretion and may warn, restrict, suspend, or ban accounts, or remove content, where we believe it violates our Community Guidelines, these Terms, or applicable law.
- What we do not promise: Providing report/block tools and reviewing some reports does not create a duty to pre-screen all content, monitor all conduct, respond within any particular time, or take any specific action on a report. We are not obligated to investigate every report or to find or remove all objectionable material.
- Your responsibility: Block and report are useful tools, not a guarantee of safety or enforcement. You remain responsible for your interactions and should not rely on TrueMove to prevent or stop harmful user behavior before it occurs.
- No liability for moderation decisions: To the fullest extent permitted by law, TrueMove is not liable for user conduct or content whether or not it was reported, blocked, or known to us, and is not liable for any action, delay, or inaction in response to a report or safety concern.
5. Gifting, Purchases, and Refunds
TrueMove facilitates the sending of physical gifts to enhance connections. By making a purchase, you agree to the following terms:
- Immediate Capture: When you send a gift request, payment is captured immediately.
- Sender Cancellation: You may cancel a gift for a full refund anytime before the recipient accepts, whether sent with a new connection request or in an existing chat.
- Refund On Decline Or Expiry: If the recipient declines a connection request (when a gift was sent with it) or the request expires, a full refund is issued to the sender. For gifts sent in an existing chat, we do not offer decline (to keep chat gifting simple); if not accepted within 30 days, the gift expires and the sender receives a full refund.
- Lower-Value Swap Refunds: If the recipient selects a replacement item of lower value before claiming the gift, any applicable difference collected is refunded to the sender.
- Final Sale After Acceptance: Once the recipient accepts and confirms the gift, the order is processed and becomes Final Sale. After acceptance, we cannot offer cancellations or ordinary refunds except as described in our gifting policy.
- Intermediary Role: TrueMove facilitates gifting and order coordination through third-party service providers (including payment, fulfillment, and shipping partners). We are not the manufacturer of gift items and do not guarantee third-party performance. We do not disclose the recipient's shipping information to the sender.
- Final Amount Shown Before Payment: All prices are shown in USD. The total shown at checkout before payment is the amount charged for that order at the time of purchase.
- Errors And Fraud: We reserve the right to correct pricing errors, refuse transactions, or cancel orders suspected of fraud, abuse, or policy violations.
- Physical Goods Only: Purchases through TrueMove are for physical goods shipped to recipients. TrueMove does not sell digital goods or digital content within the platform.
- Delivery Disclaimer: Delivery timelines depend on fulfillment partners, carriers, and external conditions. TrueMove does not guarantee delivery dates. We may provide tracking when available.
- Fraudulent Chargebacks: If a user initiates a chargeback or payment dispute after a valid completed transaction, TrueMove may suspend or permanently ban the associated account and restrict future access to the Service.
- Orders During Account Deletion: If an account is deleted while a gift order is pending, accepted, or in shipment, the order may continue to be processed and fulfilled according to the original transaction terms.
6. User Content (Your Rights and Ours)
- You Own Your Content: You retain ownership of the photos and text you upload to TrueMove.
- Your Responsibility: You are solely responsible for all content you post, send, or share through the Service, and for any consequences that result from it.
- License to Us: By uploading content, you grant TrueMove a worldwide, royalty-free, non-exclusive license to host, store, use, display, reproduce, and modify your content strictly for the purpose of operating, developing, and improving the Service (e.g., showing your profile to other users).
- No Endorsement: TrueMove does not endorse, verify, or guarantee the accuracy of user content. Views expressed by users are their own.
- No Monitoring Obligation: We provide report and block tools (see Reporting, blocking, and moderation above). We may remove content or take enforcement action at our sole discretion, but we are not obligated to monitor, screen, or review all user content or conduct, or to respond to every report.
- Prohibited Content: You may not upload nudity, pornography, violence, or copyrighted material you do not own. We reserve the right to remove any content at our sole discretion.
7. Copyright Infringement (DMCA)
If you believe your work has been copied in a way that constitutes copyright infringement, please provide a notice containing the following to our Copyright Agent at support@truemove.app:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed;
- A description of where the material that you claim is infringing is located on the Service;
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
8. Safety, User Conduct, and Offline Interactions (IMPORTANT)
TrueMove is a platform. We provide tools for outreach, messaging, and optional gifting. We are not responsible for the conduct, statements, gifts, or actions of any user on or off the Service, and we do not guarantee the identity, intentions, or behavior of any user.
- No Background Checks: We do not conduct criminal background checks or identity verification on our users. You are solely responsible for your interactions with others.
- User Responsibility: You agree to use caution in all interactions, especially if you choose to communicate off the Service or interact in person. You are solely responsible for your own conduct and for any gifts you choose to send or accept.
- Release of Liability: To the fullest extent permitted by law, you hereby release Givioo Techcrafters LLC and its officers, directors, employees, agents, and affiliates from any claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with: (a) other users' conduct, content, or gifts; (b) your interactions with other users, on or off the Service; or (c) any dispute between users.
- Offline Interactions: If you choose to take a conversation off-platform or interact in person, you acknowledge that TrueMove cannot vet users or guarantee their identity, and you assume that risk.
9. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEMOVE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT YOU WILL RECEIVE A REPLY, A CONNECTION, OR ANY PARTICULAR OUTCOME FROM USING THE SERVICE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CONTENT SUBMITTED BY USERS IS ACCURATE OR RELIABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- No Consequential Damages: IN NO EVENT SHALL GIVIOO TECHCRAFTERS LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SERVICE.
- User and Third-Party Acts: WE ARE NOT LIABLE FOR CLAIMS ARISING FROM USER CONTENT, USER CONDUCT, DISPUTES BETWEEN USERS, OFF-PLATFORM INTERACTIONS, OUR MODERATION OR ENFORCEMENT DECISIONS (INCLUDING ANY FAILURE TO ACT ON A REPORT), OR THE ACTS OR OMISSIONS OF THIRD-PARTY PROVIDERS (INCLUDING PAYMENT, FULFILLMENT, OR SHIPPING PARTNERS), EXCEPT AS REQUIRED BY APPLICABLE LAW OR AS EXPRESSLY STATED IN OUR GIFTING POLICY FOR COVERED PRODUCT DEFECTS OR FULFILLMENT ERRORS.
- Cap on Total Liability: OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TRUEMOVE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100 USD).
Some jurisdictions do not allow certain limitations of liability; in those cases, the above limits apply to the fullest extent permitted.
11. Indemnification
You agree to indemnify, defend, and hold harmless Givioo Techcrafters LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your content or conduct; (c) your violation of these Terms or our policies; or (d) your violation of any rights of a third party (including other users).
12. Dispute Resolution (Arbitration Agreement)
PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS.
- Mandatory Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA).
- Class Action Waiver: YOU AND TRUEMOVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
- Venue: The arbitration shall be conducted in the state of Wyoming, or at another mutually agreed location.

13. App Store Terms (Apple/Google)
The following applies if you accessed the Service through the Apple App Store or Google Play Store:
- These Terms are between you and TrueMove, not Apple or Google.
- Apple and Google have no obligation to furnish maintenance or support services for the App.
- You acknowledge that Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you.

15. Governing Law and Survival
- Governing Law: These Terms are governed by the laws of the State of Wyoming, excluding conflict-of-law principles.
- Survival: Sections 5, 6, 8, 9, 10, 11, 12, and 15 survive termination of your account or these Terms.
